Membership is limited to attorneys who have won million and multi-million dollar verdicts, awards, and settlements. Fewer than one percent of U.S. lawyers are members.</p><p>Sam Allen is a graduate of the University of Tennessee School of Law. /> Ever since I was a child, I knew that I wanted to stand up for people who were victimized, bullied, or hurt by others. Becoming a trial lawyer was a meaningful way for me to do this, and to help victims obtain a measure of justice for the harms they have suffered. I am fascinated by science, medicine, and technology, and so I naturally gravitated toward representing people whose legal cases involve these types of things. I enjoy the creative aspects involved in developing and presenting a case, with computers and high-tech equipment, and focusing on telling my clients’ stories in a visually and verbally compelling way.</p><p><strong>Personal:</strong> Mark lives in Mount Pleasant with his wife Debbie (a critical care nurse) and son Connor. His oldest child, Rachel, is a textile designer living in New York, and his middle daughter, Megan, is a junior at The University of Texas at Austin.</p><p><strong>Hobbies:</strong> Mark enjoys Mac computers and creating Keynote presentations, reading (fiction, science, military strategy and tactics, Greek and Roman history), exercising, traveling, music, and sometimes hunting. Although he left the Lone Star state years ago, he still cannot escape the need to slow-smoke a brisket on mesquite wood from time-to-time. E.M.A. &#8211; In a ruling handed down March 19, 2013, the Supreme Court struck down a North Carolina law that set a fixed lien on awards to Medicaid recipients. North Carolina had a law in place to take one-third of all the money Medicaid claimants get in suits against doctors and hospitals, but the Supreme Court rejected North Carolina’s fixed rule, directing that North Carolina instead set up a process that decides in each case how much of the money is for medical expenses (which the state gets) and how much is for other damages such as pain and suffering (which the claimant gets to keep). title="car accident lawyer charleston" href="http://clorelaw.com/practice-areas/charleston-car-accidents/">automobile accident</a>, you’ll want to do everything you can to keep everyone safe, and to make sure you can recover any losses coming out of it. So keep these tips in mind:</p><ol><li>Stay calm and assess the situation. Contact the police and, if needed, medical personnel.</li><li>Exchange information with the other driver(s) &#8211; name, address, telephone number, insurance information, driver’s license number and license tag.  Do not discuss the facts of the accident with the other driver(s), and do not admit fault.</li><li>Take pictures of the vehicles and accident scene.  Note damage to the vehicles, skid marks and important points of reference so that you can describe what happened.  Write down your recollection of the events, using sketches and diagrams.</li><li>Talk to any witnesses to the accident and get their contact information.</li><li>When the police arrive, get the reporting officer’s name and badge number. Ask how you can obtain the accident report.</li><li>Contact your insurance company.  If they want to take a statement about the accident and injuries you may have suffered, you should consult an attorney before doing so.</li><li>The other driver’s insurance company may also request a statement.   To be fully advised on what to expect, you should consult an attorney before discussing anything with them as well.</li><li>Even if you do not feel injured at the scene of the accident, use caution in stating that you were not injured. The case has been on appeal and just today was affirmed by the U.S. Court of Appeals for the Fourth Circuit, sending an important signal for future cases involving a claim of FDA preemption. href="/downloads/NovartisCaseUpheld.pdf"><img
class="alignleft" alt="" src="http://clorelaw.com/wp-content/uploads/2013/02/downloadpdf.png" /></a>In their opinion, the Fourth Circuit unanimously rejected the premise of an FDA preemption defense and agreed with the plaintiffs that a review of products does not negate a manufacturer’s liability in cases where the manufacturer is shown to have not appropriately advised of pertinent risks during the evaluation process.</p><p>In the case of <a
title="Vernon Glenn involved in important case   against Novartis Pharmaceuticals" href="http://clorelaw.com/novartis-award/">The Estate of Rita Fussman v. Novartis</a>, the plaintiffs successfully showed that the Novartis drug Zometa was given to a cancer patient and caused significant injury to the dying woman. Although Zometa was prescribed as a bone strengthening drug, it had the undisclosed side effect of osteonecrosis of the jawbone, causing deterioration of her jawbone, partial collapse of her face, and the loss of almost all of her teeth. Novartis argued that they had made proper disclosure and that the drug had been approved by the FDA, thus releasing them from liability. Attorneys for the plaintiff showed that Novartis withheld information about these side effects during the FDA approval process and were therefore liable for the injuries to Mrs. Fussman.</p><p>The case was originally tried in the U.S. District Court for the Middle District of N.C., before Judge James A. Beaty, Jr., and after three days of deliberation, the jury found for the plaintiff and awarded $12,887,000 in damages.  In order to conform to applicable punitive damages law, the award was reduced by Judge Beaty to $1,258,083.</p><p>Commenting on the case, Glenn said,</p><blockquote><p>We believe in the right to trial by jury and the Seventh Amendment, and we were glad to try to this case in front of regular people from all walks of life in the Piedmont of North Carolina. Even though Rita Fussman is no longer with us, this case stands for her rights and those of her husband.</p></blockquote><p>There are hundreds of cases involving this drug currently being adjudicated throughout the United States, in Multi-District litigation.
